Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Tala ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. Tala is intended for use by parents, caregivers, teachers, and speech-language professionals to support communication for children.

2. Description of Service

Tala is an AAC (Augmentative and Alternative Communication) app that helps children communicate using personalized communication boards, visual schedules, routines, and timers. The App uses artificial intelligence to generate personalized content and text-to-speech technology for voice output.

3. User Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account and parent PIN.
• You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
• One account is intended for one family or one professional. You may not share your account credentials with others.

4. Subscription and Payment

• Tala offers a 7-day free trial for new users.
• After the trial, a monthly subscription of $2.99/month is required to continue using the App.
• Teachers and speech-language professionals receive free access.
• Payment is processed through Apple's App Store. All billing is managed by Apple according to their terms.
• You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple according to their refund policy.

5. Acceptable Use

You agree to use Tala only for its intended purpose of supporting communication. You may not:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or services
• Use automated systems to access the App in a manner that sends more requests than a human can reasonably produce
• Resell, redistribute, or sublicense the App or its content

6. Content and Intellectual Property

• The App, including its design, code, AI-generated content, illustrations, and audio, is the property of Tala and is protected by intellectual property laws.
• Communication boards and schedules you create are your content. You retain ownership of any custom text, images, or configurations you add.
• You grant Tala a limited license to process your content as necessary to provide the service (e.g., sending profile data to AI for board generation).

7. AI-Generated Content

Tala uses artificial intelligence to generate communication boards and process natural language requests. While we strive for accuracy and appropriateness:

• AI-generated content is provided as a starting point and should be reviewed by the parent or caregiver.
• We are not responsible for any inaccuracies in AI-generated content.
• You may edit, add, or remove any content generated by the AI.

8. Children's Safety

Tala is designed for use by children under the direct supervision of a parent, caregiver, or professional. The App includes parent-only areas protected by a PIN code. You are responsible for:

• Supervising your child's use of the App
• Reviewing and approving content on communication boards
• Keeping your parent PIN confidential from children

9. Account Deletion

You may delete your account at any time from the Security section in Parent Settings. Account deletion will permanently remove all server-side data associated with your account, including your email, session data, cloud backups, and email enrollment records. Local data on your device will also be cleared upon deletion.

10. Privacy

Your use of Tala is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Disclaimers

• Tala is a communication aid and is not a substitute for professional speech therapy, medical advice, or clinical intervention.
• The App is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation of the App.

12. Limitation of Liability

To the maximum extent permitted by law, Tala and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

13. Changes to These Terms

We may update these Terms of Use from time to time. If we make material changes, we will notify you through the App. Continued use of the App after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
